OVERVIEW

Welcome to The Burnt Chef Project online store (the “Store”).
The terms “we”, “us”, “our” refer to The Burnt Chef Project.
We operate this Store, including all related information, content, features, tools, products and services (together, the “Services”).
The Store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”) together with any policies referenced in them describe your rights and responsibilities when you use the Services.
Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services you agree to be bound by these Terms and by our Privacy Policy  and Refund & Returns Policy.
If you do not agree, please do not use the Services.


1. ACCESS AND ACCOUNT

You must be at least 18 years old to purchase from the Store.
If you allow a minor dependent to use the Services on a device you own or manage, you accept responsibility for their actions.

You may be asked to provide information such as name, email, billing, shipping and payment details.
You confirm that all information you provide is accurate, current and complete, and that you have the right to provide it.

You are responsible for maintaining the security of your account and for all activity under it.
Accounts may not be sold, assigned or transferred.


2. OUR PRODUCTS

We aim to describe and display our products as accurately as possible.
However, colours and appearance may differ slightly from how they appear on your screen due to device settings.

We do not guarantee that any product will meet your expectations or appear exactly as pictured.
All descriptions, prices and availability may be changed or withdrawn at any time without notice.
We may limit sales of any product to any person, region or jurisdiction.


3. ORDERS

Placing an order is an offer to buy.
We will confirm acceptance (normally by email) once payment has been received and processed.
We may decline or cancel any order at our discretion.
If we cancel or change an order we will try to notify you using the details you provided.

Your purchases are subject to our Refund & Returns Policy.

You confirm that purchases are for your own personal or household use and not for resale or export.


4. PRICES AND BILLING

Prices, discounts and promotions may change without notice.
The price charged will be that shown at checkout at the time you place your order.

For UK customers, prices are shown inclusive of VAT unless stated otherwise.
Delivery charges and any duties/taxes for international destinations will be shown at checkout or advised before you confirm your order.

You agree to provide current and accurate payment information and to keep your details up to date.
By providing payment details you confirm that you are authorised to use the chosen method and that your payment provider will honour the charges.


5. SHIPPING AND DELIVERY

Orders are usually shipped either:

  • from our UK warehouse for UK customers, or

  • domestically within the relevant country for international orders (for example, via local print-on-demand fulfilment).

Delivery times are estimates only and not guaranteed.
We are not responsible for delays caused by carriers, customs or events outside our control.

For consumer purchases, risk of loss or damage passes to you on delivery to you or to someone you nominate (unless you arrange your own carrier).
Ownership passes once we receive full payment.


6. RETURNS, CANCELLATIONS AND REFUNDS (UK consumers)

You have certain statutory rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.

Cooling-off period:
You may cancel your order for most goods within 14 days of the day after you (or the person you nominate) receive them.
To cancel, email us at info@theburntchefproject.com with your order number and a clear statement.

Returns:
If you cancel, you must return the goods within 14 days of telling us.
Unless we agree otherwise, you are responsible for return postage.
We will refund the price you paid (including the standard delivery cost, if any) within 14 days of receiving the goods back or receiving evidence that you have sent them, whichever is sooner.
Refunds are made to your original payment method.

Exclusions:
Your right to cancel does not apply to:

  • personalised or made-to-order items,

  • sealed goods not suitable for return for health or hygiene reasons once unsealed,

  • digital content after download or streaming has begun with your consent.

This does not affect your legal rights if goods are faulty or misdescribed.

International Orders
Many of our products are made to order and fulfilled locally within each shipping country.
Outside the UK, local consumer protection laws may differ.
Unless local law gives you additional cancellation rights, we do not accept returns or provide refunds for made-to-order items once production has begun, except where an item arrives faulty, damaged, or not as described.

If your order is faulty or arrives damaged, please contact us within [14] days of delivery at info@theburntchefproject.com with photos and your order number so we can resolve the issue.

 

For stock items (not made to order), your right to cancel or return will follow the mandatory consumer laws in the country of delivery.

7. INTELLECTUAL PROPERTY

All content in the Services — including text, images, graphics, logos, video, audio and their arrangement — is owned by us or our licensors and protected by UK and international IP laws.

You may use the Services and its content only for your personal, non-commercial use.
You must not copy, reproduce, distribute, display, create derivative works from or otherwise exploit any part of the Services without our prior written permission.

Our name, logo, and product names are our trademarks.
You may not use them without written consent.
Shopify’s names and logos are trademarks of Shopify.


8. OPTIONAL TOOLS

We may provide access to third-party tools on an “as is” and “as available” basis.
We do not monitor or control them and are not liable for your use of them.
Use them only if you agree to the third-party’s own terms.


9. THIRD-PARTY LINKS

The Services may contain links to third-party websites.
We are not responsible for their content, accuracy or policies.
If you choose to access them you do so at your own risk.
Please review the relevant third-party terms and policies before transacting.


10. RELATIONSHIP WITH SHOPIFY

The Store is powered by Shopify.
All sales, however, are made directly between you and The Burnt Chef Project.
Shopify is not responsible for any aspect of your purchases or any injury, damage or loss arising from them.
You release Shopify and its affiliates from all claims relating to your transactions with us.


11. PRIVACY

We process your personal data in accordance with our Privacy Policy and Cookie Policy.
Because the Store is hosted by Shopify, some data is also processed by Shopify — see Shopify’s Privacy Notice.
Data may be processed or stored outside the UK/EEA subject to appropriate safeguards.


12. FEEDBACK AND REVIEWS

If you submit reviews, ideas or other content (“Feedback”), you grant us a world-wide, royalty-free licence to use, display, reproduce and distribute it in any medium for the purposes of operating, improving and promoting the Services.
You confirm you own or have the right to grant this licence and that your Feedback complies with law and these Terms.
We may remove unlawful or inappropriate Feedback.


13. ERRORS AND OMISSIONS

We try to ensure all information is accurate but may occasionally correct errors, inaccuracies or omissions relating to descriptions, pricing, promotions, offers, shipping charges, availability or transit times.
We may update or cancel orders to correct such issues, including after you have submitted an order, if the error is obvious and would reasonably have been recognised as such.


14. PROHIBITED USES

You may use the Services only for lawful purposes.
You must not, for example:

  • break any law or infringe others’ IP rights,

  • harass, threaten or defame any person,

  • upload malware or try to disrupt the Services,

  • attempt to gain unauthorised access, circumvent security, or reverse-engineer code,

  • use the Services for spamming, scraping, phishing or other abusive practices.

We may suspend or terminate your access if you breach this section.


15. TERMINATION

We may terminate or suspend your account or access to the Services at any time if you breach these Terms.
You remain responsible for all charges due up to the termination date.
Sections that by their nature survive termination (including IP, Feedback, Limitation of Liability, Indemnity, Governing Law) will continue to apply.


16. DISCLAIMER OF WARRANTIES

Except as expressly stated by us or required by law, the Services and all products are provided “as is” and “as available”, without any warranties of any kind.
We do not guarantee that use of the Services will be uninterrupted, timely, secure or error-free.

Nothing in these Terms affects your statutory rights as a consumer.


17. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by our negligence,

  • fraud or fraudulent misrepresentation, or

  • any other liability that cannot legally be limited or excluded.

Subject to that and to your statutory rights:

  • we are not liable for loss of profits, sales, business, revenue, data, goodwill, or for indirect or consequential loss; and

  • our total liability for any claim relating to a product or the Services is limited to the greater of £100 or the amount you paid for that product.


18. INDEMNITY

You agree to indemnify us, Shopify and our respective officers, employees and contractors against claims, damages or expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of law or third-party rights, or your misuse of the Services.


19. SEVERABILITY

If any part of these Terms is found unlawful or unenforceable, the remainder will continue in effect.


20. WAIVER AND ENTIRE AGREEMENT

Any failure by us to enforce a right under these Terms is not a waiver of it.
These Terms, together with the policies they reference, form the entire agreement between you and us and replace any prior understandings.


21. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations without your consent.


22. GOVERNING LAW AND JURISDICTION

These Terms and any dispute or claim (including non-contractual disputes or claims) are governed by the laws of England and Wales.
You and The Burnt Chef Project agree to the non-exclusive jurisdiction of the courts of England and Wales.


23. CHANGES TO THESE TERMS

You can review the most current version of these Terms on this page at any time.
We may update them by posting a new version here.
We will notify you of any material changes in line with applicable law.
Your continued use of the Services after changes are posted means you accept the updated Terms.
